1. DEFINITIONS:

1.1 In this instrument, we understand the expressions below in accordance with the following definitions:

USERS:

1. a) VISITOR: Individual without registration on the PLATFORM, who accesses the advertising content offered by ADVERTISERS on the PLATFORM.
2. b) CONTRACTOR: Individual registered on the PLATFORM, who accesses the advertising content offered by ADVERTISERS on the PLATFORM.
3. c) PREMIUM CONTRACTOR: Individual registered on the PLATFORM, who accesses the advertising content offered by ADVERTISERS on the PLATFORM in the premium paid mode.
4. d) ADVERTISER: Individual registered on the PLATFORM, who, when using it, will disseminate their advertisements to VISITORS.
5. e) SUBSCRIBER: Individual registered on the PLATFORM as an ADVERTISER, who, when using it, hires the PLATFORM’s services to optimize the search for their advertisements for VISITORS.
6. f) PLATFORM: System consisting of a web application, where advertising space is allocated for advertisements, in which all USERS can view advertisements published by ADVERTISERS registered on the FATAL MODEL platform.

2. MEMBERSHIP:

2.1 This instrument regulates the conditions of use of the PLATFORM’s services and is a contract between USERS and ANGEL CLASS. The use of the services offered through the PLATFORM expressly indicates that you agree with all the terms and conditions contained in this instrument and with the legal provisions applicable to the species.

2.2 YOU UNDERSTAND AND AGREE THAT ANGEL CLASS WILL CONSIDER THE USE OF THE SERVICES PROVIDED AS ACCEPTANCE OF THESE TERMS AND ALL OTHER LEGAL PROVISIONS PERTINENT TO THE TYPE.

2.3 BY ACCEPTING THE TERMS OF THIS INSTRUMENT, THE USER EXPRESSLY AUTHORIZES THE PROCESSING OF HIS DATA IN ORDER TO GUARANTEE THE MAINTENANCE AND GOOD PERFORMANCE OF THE PLATFORM’S FUNCTIONALITIES.

2.4 THE USER HEREBY EXPRESSES ITS COMPLETE CONSENT TO THE SHARING OF THE DATA COLLECTED AND PROCESSED BY FATAL MODEL, UNDER THE TERMS OF THIS INSTRUMENT, WITH OTHER COMPANIES THAT ARE PART OF ITS ECONOMIC GROUP, OR ARE ITS SERVICE PROVIDERS.

2.5 If you DO NOT AGREE with the provisions set out in this instrument, DO NOT access, view, download or use in any way any FATAL MODEL page, content, information or service.

2.6 These terms are available to read, at any time, on the PLATFORM, at https://angelclass.com.au/index.php/privacy/

3. GENERAL CONDITIONS OF USE:

3.1 ANGEL CLASS is only a PLATFORM for the assignment of advertising space, and its responsibility is restricted solely to the correct functioning of the PLATFORM and its functionalities, in accordance with this instrument, and ANGEL CLASS does not hold any responsibility for: (i) any negotiations carried out between USERS; ( ii ) verification whether the ADVERTISER actually has the qualification stated in their advertisement; ( iii ) the quality of the advertisements; ( iv ) the execution of any payment agreed between USERS; ( vii ) for possible damages resulting from third-party events, including, among others, hacker attacks and malicious software; and ( viii ) any other act or fact arising from the conduct of USERS.

3.2 ANGEL CLASS allows VISITORS and ADVERTISERS to contact each other directly, without any intervention, whether in negotiation or in carrying out what was negotiated, with ANGEL CLASS not being an intermediary or supplier of any of the services or products advertised on the PLATFORM , or employer/representative/agent of any of the ADVERTISERS registered here.

3.3 THE ANGEL CLASS:

1. a) Makes the PLATFORM available to the USER, checks the documentation sent by USERS, has no relationship with registered ADVERTISERS, and ANGEL CLASS cannot be held responsible for any damage possibly caused to VISITORS or third parties, due to acts originating from ADVERTISERS through the PLATFORM.
2. b) It has no relationship with registered VISITORS, and it is not possible to attribute responsibility to ANGEL CLASS for any damage possibly caused to ADVERTISERS or third parties, due to acts originating from VISITORS through the PLATFORM.
3. c) It does not mediate any negotiations that may be carried out between USERS, and they are solely responsible for agreeing the conditions of the business they carry out, such as value, quality, form, deadline and other points they deem necessary.
4. d) It does not interfere in any negotiations that may eventually be carried out between USERS, and they are solely responsible for agreeing any conditions for carrying out the negotiations carried out, such as value, quality, form, deadline and other points that they deem necessary.

3.4 As it does not appear as a party to the transactions that may be signed between USERS, ANGEL CLASS cannot force USERS to honor the possible obligations assumed at the time of carrying out the negotiations.

3.5 Under no circumstances will ANGEL CLASS be held responsible for any damages incurred by USERS due to any temporary unavailability of the PLATFORM.

4. REGISTRATION:

4.1 USERS must register, filling in all the data requested by the PLATFORM at the time of registration, also declaring that they meet the following prerequisites for using the PLATFORM:

1. a) Be of legal age and absolutely capable.
2. b) Have the ability to commit to these terms, providing all the information necessary to complete your registration. Declaring to provide them in a suitable and truthful manner, under penalty of criminal and civil liability.
3. c) Have a valid mobile phone number and electronic address (e-mail), through which ANGEL CLASS can contact you when necessary.

4.2 It is the sole responsibility of USERS to provide, update and guarantee the veracity of registration data, and ANGEL CLASS will not incur any type of civil or criminal liability resulting from untrue, incorrect or incomplete data provided by USERS.

4.3 VISITORS:

1. a) Email

The purpose of such collection is to identify you, as well as enable you to correctly use the PLATFORM, and, with this, ANGEL CLASS will be able to ensure the good quality of the licensed services and the legal basis is the execution of the contract.

4.4 ADVERTISERS:

1. a) Name
2. b) Surname
3. c) Membership
4. d) Identification Document Number
5. f) Presentation Video
6. g) Mobile Telephone Number
7. h) Service Data

4.5 The purpose of such collection is to identify you, as well as enable you to correctly use the PLATFORM, and, with this, ANGEL CLASS will be able to ensure the good quality of licensed services and the legal basis is the execution of the contract and prevention of frauds.

4.6 SUBSCRIBERS:

1. a) Name
2. b) Surname
3. c) Membership
4. d) Identification Document Number
5. f) Presentation Video
6. g) Mobile Telephone Number
7. h) Service Data
8. i) Payment Data

4.7 The purpose of such collection is to identify you, as well as enable you to correctly use the PLATFORM, and, with this, ANGEL CLASS will be able to ensure the good quality of licensed services and the legal basis is the execution of the contract and prevention of frauds.

4.8 ANGEL CLASS reserves the right to use all valid and possible means to identify its ADVERTISERS, as well as to request additional data and documents that it deems to be relevant in order to verify the data provided, including criminal records. In this case, the ADVERTISER’s use of the PLATFORM is subject to the sending of any requested documents.

4.9 If a registration is considered suspected of containing erroneous or untrue data, ANGEL CLASS reserves the right to suspend, temporarily or definitively, without the need for prior notice, the USER responsible for the registration. In the event of suspension, the USER will not be entitled to any type of compensation or compensation for losses and damages, loss of profits or even moral damages.

4.10 For better use of the PLATFORM, the ADVERTISER must keep their advertisement (profile) updated with the following data: i) profile description; ii ) opening hours; iii ) service time; iv ) services provided; v) additional services; and, vi) service locations.

4.11 The advertisement is unique, personal and internally identified by the DOCUMENT of the registered ADVERTISER, and must belong to the individual, holder of the documents provided at the time of registration, and cannot be shared, belong to a group of people, be transferred or sold in any form or pretext. Simulation, concealment of information or induction into error constitute a serious breach of this document, and subject the ADVERTISER to the penalty of banning, in addition to the legal sanctions provided for by law.

4.11.1 THE ADVERTISER is aware that, if he chooses to delete his account, when restoring it, all previously entered information will be reestablished, maintaining the integrity of his data, since his advertisement is linked to the registered DOCUMENT.

4.12 The creation of more than one registration per USER on the PLATFORM is expressly prohibited. In case of multiple registrations created by a single USER, ANGEL CLASS reserves the right, at its sole discretion, without compensation and without the need for prior consent or communication, to disable all existing registrations in the name of this USER, and may not accept new registration of said USER on the PLATFORM.

4.13 The USER undertakes to notify ANGEL CLASS immediately, through the contact channels maintained by ANGEL CLASS on the PLATFORM, regarding any unauthorized use of their account. The USER will be solely responsible for the operations carried out on his account, as access will only be possible through the use of a password known exclusively by him.

4.14 The USER undertakes to notify ANGEL CLASS immediately, through the contact channels maintained by ANGEL CLASS on the PLATFORM, regarding any knowledge of irregularities by other USERS that may cause damage to the USERS of the PLATFORM, the latter, the ANGEL CLASS or third parties.

4.15 Under no circumstances will the assignment, sale, rental or other form of transfer of the USER’s registration be permitted.

4.16 The surname that the USER uses on the PLATFORM cannot be similar to the name ANGEL CLASS, nor can any surname be used that insinuates or suggests linking the USER to ANGEL CLASS.

4.17 At its sole discretion, ANGEL CLASS may exclude, disable, create limits on the use of the service, suspend, block, for an indefinite period of time, without prior notice or compensation, registrations of USERS that are considered offensive, that violate the terms of this instrument or the legislation in force.

4.18 ANGEL CLASS reserves the right not to allow new registration of USERS who have already been cancelled, disabled, blocked, deleted or suspended from the PLATFORM. The creation of new registrations by people whose original registrations have been canceled, blocked, disabled, excluded or suspended due to violations of PLATFORMA’s policies or current legislation will also not be permitted.

4.19 ANGEL CLASS reserves the right to, unilaterally, without prior notice, consent or compensation, refuse any request for registration from a USER on the PLATFORM, as well as cancel, disable, block, delete or suspend the use of a previously accepted registration .

4.20 The Registration must be regularly updated every 6 months via Verification Media, to guarantee the reliability of the ADVERTISER’s identity. ANGEL CLASS may request facial authentication from the ADVERTISER at any time, thus also guaranteeing security regarding their identity.

4.21 By agreeing to this instrument, the USER declares to be aware that he or she is solely responsible for his or her registration, and it is certain that any loss caused by the insertion of outdated, inaccurate or untrue information cannot be attributed to ANGEL CLASS or PLATFORMA.

5. FEATURES:

5.1 ANGEL CLASS may at any time, without the need for prior notice or compensation, edit and/or delete existing features, as well as add new features to the PLATFORM.

5.2 At the time of registration, USERS will have access to the functionalities contracted on the PLATFORM, declaring, to this end, that they have read, understood and accepted all provisions contained in these Terms of Use.

5.3 The ADVERTISER may be permanently or temporarily removed from the list of his city or other search filter that would result in his advertisement, even if he has a current subscription or active plans, in the event of a repeated negative verification of your identity through the tools used by the PLATFORM.

5.4 The PLATFORM may also establish rules restricting access to certain functionalities, based on criteria of its own commercial convenience, including unilaterally stipulating days and/or times to apply such restrictions in accordance with the plans, or lack thereof, that each user has on your profile.

5.5 USERS may, through specific functionality, publish reviews to other USERS, and these will be subject to moderation by the PLATFORM, in the following cases:

1. a) When the review is reported by the USER evaluated.
2. b) When there are offensive words or content.
3. c) When it contains personal information that identifies a third person, brand or intellectual property.
4. d) When you violate the Terms of Use or Community Guidelines.
5. e) When it contains clearly untrue, slanderous or defamatory information.
6. f) When it violates any regulation or legislation to which the PLATFORM is subject.

5.6 The reviews are now linked internally to the USER’S DOCUMENT, and in the event of deleting an ad or creating a new one, the reviews will necessarily remain linked to the USER.

5.7 If the USER, with the aim of defrauding the functionality and misleading other users, carries out their self-assessment, they will be subject to the penalties provided for in this document. Including banishment.

5.8 ANGEL CLASS reserves the right not to moderate a given review, if it does not violate any provision of its policies, and is exempt from civil, criminal and administrative liability for content generated by third parties, and its obligation is solely to maintain regular operation of the PLATFORM.

5.9 The PLATFORM has the right to restrict the media published by an ADVERTISER user, partially or completely, the viewing of which may be restricted to VISITOR users, in accordance with criteria established by the PLATFORM, such as the regularity of registration, subscription to plans, or absence thereof, as well as the USER’s behavior, in accordance with community guidelines.

ANGEL CLASS INTELLECTUAL PROPERTY :

6.1 The USER expressly acknowledges that, through this instrument, he/she receives from ANGEL CLASS the granting of a license to use the PLATFORM, which is non-transferable, sublicensing being prohibited, for use in national or foreign territory, for as long as membership to the this term, and the use of the PLATFORM in disagreement with the provisions of this instrument is prohibited.

7. USER OBLIGATIONS:

7.1 Exclusive responsibilities of the USER:

1. a) By choosing, negotiating, agreeing on price, payment method and the respective hiring of other USERS;
2. b) For the veracity of the data provided by you on the PLATFORM;
3. c) For the security of your password and the use of your registration on the PLATFORM;
4. d) For the resolution of any and all problems with negotiations resulting from an advertisement originating from the PLATFORM;
5. e) For maintaining the update of your registration data (in particular: telephone and email) and payment data (in particular the DOCUMENT for payment via PIX);
6. f) Be liable for any damages caused to third parties, other USERS, the PLATFORM or ANGEL CLASS itself, resulting from the use of the PLATFORM’s features.

7.2 USERS must not use the PLATFORM for any purposes or means that are illegal, defamatory, discriminatory, abusive, offensive, aggressive, libelous, vexatious, misleading, slanderous, violent, vulgar, or harassing, threatening or using a false identity, i.e. , any unlawful use that could harm ANGEL CLASS, other USERS or third parties.

7.3 Under no circumstances will the USER hold ANGEL CLASS responsible for any untrue information entered by other USERS on the PLATFORM, and must also inform ANGEL CLASS of any untrue information that it identifies on the PLATFORM.

GIFTS

8.13 CONTRACTORS may send amounts, as gifts, to ADVERTISERS. The amounts sent by contractors may vary from $10.00 (ten dollars ) to $1,000 (one thousand dollars ).

8.14 Payment will be made to the ADVERTISER of your choice.

8.15 The amount will be credited within 1 (one) business day as availability in the ADVERTISER’s individual account.

8.16 Payment gateways may charge fees for their use, and the USER is solely responsible for informing themselves about the values charged, which will be deducted from the amount credited.

9. IMAGE USE LICENSE:

9.1 The USER authorizes, free of charge, unrestrictedly, irrevocably and irreversibly, ANGEL CLASS to use their image in advertisements inserted on the PLATFORM, whether in photo or video format, and without this resulting in any violation of their image rights.

9.2 The USER is aware of and agrees to the use of facial recognition technology to prevent fraud and maintain system integrity. The facial recognition data collected will be stored securely and will only be accessed by authorized and qualified professionals.

11. NAMES AND PROFILE POLICY:

11.1 Any name that is not within our Name Policy will be subject to penalties.

11.2 Names must contain:

1. a) It must contain between 5 and 18 characters.
2. b) Symbols are not allowed
3. c) Numbers are not allowed
4. d) Threats are not allowed
5. e) Swearing, nicknames, sexist, racist or transphobic treatments are not permitted.
6. f) Any type of abusive content that reduces someone to a degrading condition is not permitted.
7. g) Any type of content that incites fear is not permitted
8. h) Disclosure from other media or social networks is not permitted
9. i) The disclosure of dates, locations or time periods is not permitted.

12. PENALTY POLICY:

12.1 The penalties provided for USERS who violate the PLATFORM’s Terms of Use are: i) suspension; and ii ) banishment.

12.2 Suspension is the temporary measure of stopping the ADVERTISER’s advertisements or a USER’s access to the Platform.

12.3 Ban is the definitive measure of banning the ADVERTISER’s advertisements or access to a USER’s Platform.

12.4 In case of suspension of the USER, to return after the stated deadline, the USER must pay the Return Fee which will be calculated as follows:

(Number of days of suspension) X Daily penalty value = Return Rate

12.5 In case of non-payment of the Return Fee, at the end of the suspension period, the USER’s advertisement will remain off the list, until the Return Fee is met.

12.6 In addition to the ban scenarios mentioned throughout these terms of use, the USER, after receiving three consecutive suspensions, will be permanently banned from the platform.

12.7 Payment of the Return Fee before the end of the suspension period is not a way to eliminate the penalty, therefore the USER will only have access to the PLATFORM and its advertisements after the suspension has ended.

12.8 ANGEL CLASS reserves the right to investigate, using the means and information available to do so, and apply the penalties provided for in this document, if USERS violate the provisions of this term, behave inappropriately or otherwise considered illegal.

12.9 To this end, ANGEL CLASS reserves the right to decide on the best decision according to each specific case that indicates a violation of this document, inappropriate or illegal behavior.

12.10 In addition to the provisions of the previous sub-item, the USER is prohibited, subjecting him to immediate penalty:

1. a) Use of false documents or those belonging to third parties;
2. b) Violation of the naming policy;
3. c) Use of images, videos and media in general, including comparison, false or belonging to third parties;
4. d) Publication of images that differ from the comparison video;
5. e) Sharing the ad with more than one person or group;
6. f) Post content or express yourself in a way that violates, infringes, or discloses information of third parties, including rights of publicity, privacy, copyright, trademark or other intellectual property.

13. USE OF COOKIES:

13.1 ANGEL CLASS uses cookies to improve your user experience. Cookies are small text files that are stored on your device when you visit our website. These files contain information about your browsing activities and help us provide a better, more personalized service.

13.2 We may use session cookies that are automatically deleted when you close your browser and persistent cookies that remain on your device until you delete them or they expire. We use these cookies to recognize you when you return to ANGEL CLASS and to remember your preferences and settings.

14. GENERAL PROVISIONS:

14.1 Any clause or condition of this instrument that, for any reason, is considered null or ineffective by any court or tribunal, will not affect the validity of the other provisions of these Terms, which will remain fully valid and binding, generating effects to their maximum extent .

14.2 The failure of ANGEL CLASS to enforce any rights or provisions of these Terms will not constitute a waiver, and you may exercise your right regularly, within the legal deadlines.

14.3 All materials, patents, brands, registrations, domains, names, privileges, creations, images and all rights connected and related to the PLATFORM and developed by ANGEL CLASS, are and will remain the sole and exclusive property of ANGEL CLASS, agreeing to USERS not to perform any act or fact that, in any way, harms the rights provided for herein nor to claim any right or privilege over them.

14.4 ANGEL CLASS may change this instrument at any time, simply by publishing a revised version on our website. For this reason, we strongly recommend that you always visit this section of our Website and read it periodically. However, to contribute to a good relationship, we will also publish a notice about these changes.

SUBSCRIPTION CONTRACTING TERMS AND CONDITIONS

The parties to this instrument are, on the one hand, ANGEL CLASS, on the other hand, the natural or legal person identified in the Electronic Registration by their Subscriber Code, hereinafter identified simply as SUBSCRIBER.

1. OBJECT OF THE TERMS AND CONDITIONS:

1.1 The purpose of this instrument is to establish the terms and conditions of the contract entered into between ANGEL CLASS and the SUBSCRIBER (ADVERTISER), for the contracting of a prominent plan in searches on the ANGEL CLASS platform.

1.2 The information is available to the SUBSCRIBER on the website www.angelclass.com.au. All provisions of the Terms of Use and Services apply hereto.

2. SUBSCRIPTION CODE:

2.1 ANGEL CLASS will grant the SUBSCRIBER a “Subscriber Code” to identify the SUBSCRIBER with ANGEL CLASS Customer Service, which will be the user’s identification code – AD ID. The SUBSCRIBER can find it after confirming their order and when the Products/Services are sent to the SUBSCRIBER.

3. DELIVERY AND ONBOARDING:

3.1 Delivery of Products/Services will begin immediately after contracting and confirmation of payment.

3.2 During registration, the SUBSCRIBER will have instructions available for completing the process and will be able to monitor the progress of the order via SMS and E -mail.

4. HIRING:

4.1 PRICES, PAYMENT METHODS: Contracting by the SUBSCRIBER must be carried out through the ANGEL CLASS website, which will contain all available Subscription Plans, as well as their specific conditions.

4.2 The SUBSCRIBER must choose the Subscription Plan they wish to contract, being certain that its specific conditions (Values, Deadlines, Payment Conditions, etc.) contained on the website will become an integral and inseparable part of this instrument.

4.3 THE SUBSCRIBER expressly declares and guarantees, for all legal purposes:

(I) have the legal capacity to enter into this instrument and to use the Product/Service;

(II) recognize that this instrument is formalized, binding the parties, with contractual confirmation, which will be done by clicking on the space reserved for this on the ANGEL CLASS website.

4.4 As consideration for the purpose of this contract, the SUBSCRIBER must pay ANGEL CLASS the amount corresponding to the contracted Plan, according to the option made at the time of purchase and in force at the time of purchase.

4.5 The payment method will be chosen by the SUBSCRIBER from those listed on the website for the chosen Plan, which will also include the billing frequency and any applicable penalties.

4.6 ANGEL CLASS reserves the right to, unilaterally, without the need for prior notice, readjust the values of its plans and subscriptions, preserving the conditions of contracts with a fixed term and limited validity, for as long as their validity lasts.

5. DATABASE:

5.1 THE SUBSCRIBER declares to be aware that, upon contracting a subscription to a Product/Service, it becomes part of the ANGEL CLASS database, through which it may receive information from ANGEL CLASS. If the SUBSCRIBER is not interested in receiving this information, the SUBSCRIBER is guaranteed the right to express their opposition, simply by communicating this decision to ANGEL CLASS Customer Service.

5.2 The inviolability and confidentiality of the registration data of all its SUBSCRIBERS are ensured by ANGEL CLASS. All your information is stored within the strictest security criteria in the ANGEL CLASS database and is treated in accordance with applicable legislation and the platform’s terms of use, clause 10. Under no circumstances is personal information provided to third parties not related to the provision of services, object of this instrument, except with authorization from the SUBSCRIBER.

6. SUBSCRIBER CUSTOMER SERVICE:

6.1 ANGEL CLASS provides the SUBSCRIBER with Customer Service and makes it available via email support@angelclass.com.au​​​​

7. DEADLINE:

7.1 This instrument is concluded for a period of up to 30 days, according to the SUBSCRIBER’s option on the ANGEL CLASS website, being extended for equal periods, through facilitated renewal, according to the procedure set out in the next item.

8. RENEWAL PROCEDURE:

8.1 ANGEL CLASS adopts the scheduled subscription renewal procedure, aimed exclusively at the SUBSCRIBER, ensuring ease and agility in renewal.

8.2 If the SUBSCRIBER is not interested in renewing their subscription, simply respond or contact ANGEL CLASS Customer Service via email support@angelclass.com.au​​​​

9. CANCELLATION:

9.1 ANGEL CLASS assures the SUBSCRIBER the possibility of canceling this instrument at any time, upon prior notice from the SUBSCRIBER, and respecting the provisions of the platform’s terms of use.

10. TERMINATION:

10.1 The subscription may be canceled and this instrument terminated in the event of a contractual breach, if the infringing party does not correct the default, after notification.

10.2 If the SUBSCRIBER does not pay the amount due within the period stipulated in the notification to be sent by ANGEL CLASS, this instrument may be terminated with the immediate suspension of delivery of the Products/Services.

11. CHANGES TO TERMS AND CONDITIONS:

11.1 Any changes that impact the SUBSCRIBER’s financial burden will be made through prior communication to the SUBSCRIBER, who may express their agreement, by any means available, renegotiate such changes or either party may denounce it, if they do not reach an agreement.
